A. The average time for USCIS to complete an H1b processing is 90 days. You mus talso take into consideration the additional time your lawyer will take in preparing the application, and the fact that there is apreliminary application called LCA that the lawyer files with the Dept. of Labor prior to filing with USCIS and that sometimes takes a couple of weeks. You need to be clear with the lawyer about your timetable and follow up with e-mails or calls to make sure the paralegal on the case keeps you informed. Objections are mainly in these category: you are not qualified for they job bec. your foreign diplomas are not equivalent to US diplomas, not have required experience, your employer does not agree to pay you the min wage that DOL/USCIS… [cont.]

How can I renew my tourist visa to Turkey?
Q. My three-month (does this mean an exact 90 days, by the way, or the same date three months later?) Turkish tourist visa expires in about three or four weeks and I want to renew it. A. Unless u can prove that u have serious reason to stay longer than 180 days then you can show to visa officials & they will change ur visa category. In a visit / tourist category they do not expect you to stay in a country more than 180 & would assume that you will return to your homeland to resume your normal life. So if I am visa officer I'd ask you first thing, why do u want to stay more than 180 days? You can have/apply upto 5 (10 in some cases) years of valid visit visas but maxium allowed duration is 180 days then u leave for at least 15 days to return back (but entry port officer can still be suspicious & can ask many questions). In the end all depends upon visa officer, but ur case will not be refused if u have genuine reasons… [cont.]

Is it possible to switch from H1 to L1 visa without returning to home country?
Q. I have a valied H1 visa and i am working in US. Because of some cost cutting measures, my parent company in India has decided to call off all H1 employees (employees on L1 visa are paid less than H1 employees, i believe!!) After returning, they want to process L1 visa and send me to US for a short term project. I understand that one can not have H1 and L1 visas at the same time! Is it possible at all to convert from H1 to L1 visa without going back to India? As i will still be working for the same employer, can they cancel the H1 and issue an L1 immediately? A. The quota for H-1 visas for 2007 has already been filled. I think you can start your own business and get a tax ID no for it, you just wont be able to be employed by your own business. However as long as that business pays it's taxes I'm fairly sure as the sole propreitor of that business you can spend the profits on whatever you would like, if you get my drift. I advise looking into the rules at uscis.gov.

A. 99% of countries do not require a visa when you are a Crew/Staff member. You are listed as a crew member on the ship s manifest and that's it. However, the US does require a C1/D crewmember's visa. Brazil requires if you are doing the so called "season", from November/December until March several ships stay within Brazilian waters, so for those you need one as well. And some other countries still require a Seaman s Book, which is sort of a passport for crew members and should be issued by either your country of citizenship or the country of the ship's flag (so a lot of people get the Bahamian one, since most ships have Bahamian flags, also it's cheap and you only have to apply).
